This Privacy Policy explains how We use any personal information collected about You when using Our Website or Service. We outline the type of personal information that is received, collected and used by Us. By disclosing Your personal information to Us, You consent to the collection, storage and processing of Your personal information under the conditions of this PP.

By using and accessing www.happitudeatwork.com, or using our Service, You accept and agree to this PP. For the purpose of the Swiss Federal Act of 19 June 1992 on Data Protection Act 1998 (the “Act”), the controller of the data file is Happitude at work GmbH. 

1        TERMS USED

The Privacy Policy (PP) have the following meaning:

  • Agreement: the Engagement Agreement between You and Us that specifies the services to be delivered by Us to You and the applicable Fee
  • Client or You: the party working with Us or accessing our Website
  • Happitude at work or We: Happitude at work GmbH, with a registered seat in Mägenwil, Switzerland, under the number CHE-204.214.854
  • Service: the agreed work to be performed and delivered by Happitude at work to You, as specified in the Agreement
  • Website: happitudeatwork.com and any other related sites and social media profiles.

2        COLLECTION OF PERSONAL INFORMATION

Here we detail which data we collect

When You subscribe or update Your details, use or register to use Our Services, or otherwise interact with Our Website or Us, We may collect, store and use the following types of Your personal information:

  • Your name, email address, phone number, company
  • material submitted by You to Us including but not limited to information provided during the coaching sessions, answers to questions on surveys or registration forms, comments on the chat and forums, and other
  • transactional information based on Your interactions with Us
  • information from Your interaction with Us, purchase of Services, including, but not limited to  Your device ID, device type, location, geo-location information, demographic information, computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information
  • any other information from which You can be identified and which You may disclose to Us at any time.
  • information which You transmit to Us when using the HAPPICARDS service, in particular the text, which you send to the recipients in the process

 

3        USE OF PERSONAL INFORMATION

Here we list for what purposes is the personal data used

We may use Your personal information for the following purposes:

  • to manage and administer Our Website or Service
  • to send periodic emails and newsletters with valuable content, promotion offers & surveys
  • to deal with enquiries, complaints and feedback from You
  • to provide third parties with statistical anonymised information about Our users
  • to investigate any suspected breaches of Happitude at work Terms & Conditions or applicable rules and policies
  • to follow up with You.

4        STORAGE PERIOD AND LOCATION

Here we outline how long we will store Your data

We retain Your data only for as long as necessary – Your information will be kept with Us until we collaborate together, You voluntarily and proactively give Your consent to receive any communication from Us, or until You notify Us that You no longer wish to receive communication from Us, informing us per email or automatically unsubscribing directly Yourself.

HAPPICARDS (and the texts you sent with them) are stored on the server for 2 months, after that, they are deleted.

Here we state where we store the personal data we collect from the users

The personal information that We collect from might be transferred to and stored in the European Economic Area (“EEA”). By submitting Your personal information, You agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that Your personal information is treated securely and in accordance with this PP.

5        PERSONAL INFORMATION DISCLOSURE

This explains that we do not pass personal information to others for promotional activity

Except as set out below and to the extent required by any applicable law or governmental or judicial body, we will not disclose Your personal information to any third party.

We use the personal information collected from You only for the purposes outlined in Section 3. We will not rent, sell or share Your personal information with any third party for its own marketing purposes without Your consent. We take all reasonable measures to ensure Your private data is kept secure.

By using our HAPPICARDS service, you send a personal text to a third party. Here too, we respect your privacy, which means that the texts are not carefully checked. The company therefore assumes no liability or guarantee for the correctness and content of the texts.

The payment information You provided will be passed on to and processed by Our third party payment partners. We do not store Your payment information.

We may pass Your personal information to Our employees and agents and selected service providers to Us under the same conditions that are defined in this PP. We may provide general statistical information about Our users on an aggregated basis. Such data will not include information personally identifying You.

We may disclose Your personal information to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence or suspected breach of Our Terms & Conditions and/or the breach of other terms and conditions otherwise relating to You or otherwise required by law. We will cooperate with law enforcement agencies and will comply with any court order requesting or directing us to disclose the identity of (or personal information relating to) any user of Our Website or Service.

You should also be aware that if You voluntarily disclose Your personally identifiable information on message boards or in chat areas, that information can be viewed publicly and can be collected and used by third parties without Our knowledge and may result in unsolicited messages from other individuals or third parties. Such activities are beyond Our control and responsibility.

6        USE OF LOG FILES, COOKIES AND WEB BEACONS

Here we explain what cookies and web beacons are and how we use them

The information inside the log files includes internet protocol (IP) addresses, type of browser, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and number of clicks to analyse trends, administer the Website, track user’s movement around the Website, and gather demographic information. IP addresses, and other such information are not linked to any information that is personally identifiable.

Cookies are text files stored, either on a temporary or persistent basis on the hard drive of Your computer. Cookies are used for authenticating, session tracking and maintaining specific information about the use and users of Our Website. The data collected by cookies is anonymous. You can delete all cookies that are already on Your computer’s hard drive by searching for files with “cookie” in it and deleting them. In addition, if You want to stop cookies from being stored on Your computer, You can edit Your browser settings so that cookies are blocked. If You block cookies You may not be able to use the full functionality of Our Website.

Web beacons consist of a small string of software code that represents a graphic image request on a page or email. There may or may not be a visible graphic image associated with the web beacon and often the image is designed to blend into the background of a page or email. Web beacons can be used for many purposes – including site traffic reporting, unique visitor counts, advertising auditing and reporting, and personalization. Web beacons used by the Us collect only anonymous data.

In order to improve the user experience, We may use (temporary and persistent) cookies, authorised third parties’ cookies, log files, web beacons and/or other technologies to collect non-personally identifiable data. This non-personally identifiable data helps Us to track browsing behavior, to create specific or tailor-made offers or advertisements, and to monitor and record the visits and use Our Website.

7        THIRD PARTY TOOLS AND WEBSITES

7.1        USE OF THIRD PARTY PLATFORMS, PLUG-INS TOOLS

We use a third party platforms, plug-ins and tools for processing payments, collecting personal and address information and for our newsletter and campaigns. Please be aware that the terms and conditions and privacy policy of the third party providers are applicable on all such transactions and interactions.

7.2        LINKS TO WEBSITES

Our Website may include links to third party websites. We are not responsible for the content of third party websites. Please ensure that prior to using any such website, You have read and understood its privacy policy and terms of service.

Our Website may use social plugins, which are provided and operated by third-party companies, such as Facebook and LinkedIn. As a result, You may send to the third-party company the information that You are viewing on a certain part of Our Website. Similarly, Your interactions with the social plugin may be recorded by the third party. Please refer to the third party’s documents to find out more about its data practices and terms and conditions.

8        YOUR RIGHTS

For users residing in Switzerland, EU and Japan

If You reside in Switzerland, EU or Japan, You may request in writing copies of Your personal information that we collect. We will provide You with a copy of the personal information held by us as soon as practicable after receiving a Your request in writing. You might request corrections of any inaccurate, incomplete or outdated information as well as deletion of the personal information.

You can also at any time inform us about an objection to processing of Your personal data, ask to restrict processing or request portability of Your personal data. You can exercise these rights by contacting us on the address stated in Section 11 of this PP.

For all users

If You have opted in to any of Our communication channels, You can opt out of it at any time by directly unsubscribing Yourself.

9        FAIR PROCESSING

This outlines what happens in case of Happitude at work’s ownership change

In case there is a Business Ownership change, for example a business owner brings a new business partner on-board, sells part of the business or the whole business to a new owner, the active data of individuals who opted-in with their consent will stay part of the database of Happitude at work and be transferred to the new owner/s. If You would prefer to be removed, You can request such deletion from Our database or simply unsubscribe from any communication directly.

10   CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend this PP. Any changes We may make to Our PP in the future will be posted on Our Website and, might be notified to You by e-mail.
